1. Acceptance
It is not necessary for any client to have signed an acceptance of these terms and conditions for them to apply. If a client accepts a quote then the client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.
2. Validity
Quotations are valid for a period of 6 months unless otherwise stated.
3. VAT
Max Newall Tree Services is VAT registered and all quotations will be subject to VAT.

4. Insurance
Max Newall tree services holds public liability of £10 million and employers’ liability to the value of £10 million.
5. Tree work standard
All tree work shall be undertaken to the specification detailed in the quotation and where appropriate undertaken in adherence to BS 3998: 2010 Recommendations for tree work.
6. Permission
The trees concerned may be subject to a Tree Preservation Order (TPO), be in a conservation area/SSSI, or be subject to other planning and felling restrictions. The customer must obtain the necessary permissions from the relevant authority before any works can be carried out. Max Newall tree services can assist with this process if requested.
7. Underground Services
Where any underground services are present at the work site where work is being undertaken, it is the responsibility of the customer to inform Max Newall tree services, who will then take the required precautions to enable to undertake the work safely. Max Newall tree services shall not be liable for any damage caused where the customer has failed to inform Max Newall tree services of the presence of underground services.
8. Weather conditions
Max Newall tree services reserves the right to delay, postpone or cancel works affected by inclement/dangerous weather conditions and to resume works as soon as conditions allow.
9. Wildlife and Countryside Act/Countryside and Rights of Way Act
Max Newall tree services shall take all reasonable steps to ensure the safe retention of any wildlife habitats and reserves the right to delay, postpone or cancel work accordingly and to resume work as soon as practical.
10. Cancellation
A minimum of 48 hours notice of cancellation of scheduled works is required, otherwise a minimum call out charge of £80.00 may be levied. If less than 24 hours notice is given for cancellation of the agreed start date, Max Newall Tree Services reserves the right to charge up to 100% of the agreed quote.
11. Site conditions
The contract price is based on site conditions as inspected by Max Newall tree services at the time the quotation was undertaken. Max Newall tree services reserves the right to levy additional costs subject to the degree of additional obstruction or to delay, postpone or rearrange works as necessary. Max Newall tree services does not accept any responsibility for any damage or loss incurred through the need to clear access for works.
12. Site inductions
Quotations allow for site inductions lasting up to 30 minutes. Inductions lasting longer than 30 minutes or that delay work being started on site by longer than 30 minutes must be agreed in advance, otherwise any time lost will be charged at Max Newall tree services standard hourly rate.
13. Work delay
If work is delayed for any reason due to third party interference and/or client issues once the date of work has been agreed, the client is liable for any and all costs incurred caused by the delay and/or the contractors standard day rate.
14. Hidden obstructions
Quotations for tree felling are based on the assumption that the trees’ interior is free from metal/stone etc. In the event of a tree being impossible to fell in the normal way, Max Newall tree services reserves the right to re-quote accordingly.
15. Worksite
Max Newall tree services shall take all reasonable steps to ensure the worksite is left clear and safe at the end of each day and on completion of all works.
16. Additional work
If, during the execution of the contract additional works are requested by the customer which are outside of the original quotation, then their cost can be agreed on site or an additional quotation can be prepared which may necessitate a further site inspection(s) by Max Newall tree services.
17. Disputes
Max Newall tree services will do everything possible to resolve any misunderstandings arising from contracted work to the satisfaction of both parties. Any disputes arising will need to be documented in writing to max@maxnewalltreeservices.co.uk within 48hours.
18. Payment
Payment will be due on completion of the work. For commercial contracted work payment is due within the number of days detailed on the quotation from satisfactory completion of works unless otherwise agreed. Payments can be made via cheque, cash or bank transfer. Late payments are liable to interest charge of 5% to be calculated daily.
19. Explanation of tree work terms
Clean out crown: Removal of dead wood, dying, diseased, weak, suppressed, split, broken, hanging crossing and rubbing branches and epicormic growth (small shoots emanating from the main trunk and stems) from the crown.
Remove dead wood: Removal of all major dead wood over approx 25mm in diameter.
Formative prune: The minimal pruning of, usually, young trees to maintain optimum initial branch structure and crown balance in order to pre-empt potential future problems.
Trim/Shear: Usually refers to hedging and shrubs both evergreen and deciduous. Being the pruning back to flatten off or round off of growth to contain spread and maintain control/optimum visual appearance and shape.
Crown lifting: Removal of lowest branches to achieve a stated vertical clearance above ground level or other surface. (The vertical clearance will usually be stated in the work specification.)
Crown thin: Removal of all branches as in 'Clean out crown' and the removal of further smaller diameter branches evenly throughout crown in order to lessen the crown density and thus improve light through the tree. Crown thinning will not result in any major alteration in the outline of the tree. (Usually expressed as a percentage).
Crown reduction: operation that results in an overall reduction in the height and/or spread of the crown of a tree by means of a general shortening of twigs and/or branches, whilst retaining the main framework of the crown.
Pollarding: Cutting a tree so as to encourage formation of numerous branches arising from the same height of a main stem or principal branches.
Fell: Complete removal as near to ground or surrounding soil level as possible of the tree, leaving a stump. Involves either the dismantling of the tree in sections or where site conditions allow felling the tree from the base.
Grind out stump: In some cases, usually with smaller shallow stumps, it would be possible to grind out the whole stump. On larger stumps the grinding of radial roots down to a certain diameter may be specified.
Grub out: Refers to the stump and roots of a tree. Being the physical /manual digging out of a stump and its root system. Usually applies to smaller trees.
Treat stump to prevent re-growth: Being the treating of the stump using either approved herbicides or the injection of Eco-plugs as appropriate to prevent any further re-growth from the stump.
